Customs filing refers to the requirement that the holder of intellectual property rights protected by the customs shall notify the General Administration of Customs in writing of the legal status of their intellectual property rights, the situation of related goods, the legitimate use of intellectual property rights, and the import and export of infringing goods, so that the customs can actively protect the relevant intellectual property rights in the supervision process of import and export goods. According to the revised "Regulations on Customs Protection of Intellectual Property Rights" in December 2003, the filing of intellectual property rights is no longer a prerequisite for customs to protect intellectual property rights. Rights holders who have not filed intellectual property rights still have the right to apply to the port customs for the detention of imported and exported infringing goods. However, there are significant differences in practice regarding whether to file intellectual property rights in advance.
